The Shire of Collie’s planning documents, including town planning, provide investors (and neighbours) the ability to predict the likelihood of a particular development being approved by the Shire or the need for further planning work. However, the planning documents do not identify other approvals that might be necessary (e.g. provision of sewerage and water supply) or take into account specific site conditions that may affect development potential (e.g. the presence of springs or wetlands). For example, in areas zoned Residential, an R Code is applied (e.g. R25) which translates to an average and minimum lot size for subdivision and development standards for residential development as outlined in the Residential Design Codes of Western Australia. However, even if the lot size means subdivision is possible, a larger lot size may be appropriate if sewerage is not available.
Areas around the Central Business District have generally been zoned R25 to encourage development in this area, and this area is least likely to be constrained by other issues.
The Residential Development zone identifies where future growth is sought and identifies that further planning work is required in the form of a Structure Plan that ensures growth occurs in an orderly manner (e.g. streets will connect, adequately sized areas of public open space are provided etc.).
Most planning documents are there to provide guidance to developers and Shire staff in decision making on proposals. However, Local Planning Scheme No. 5 has the force of law and is binding on Council.
Local Planning Scheme No. 5 can be amended through a rezoning process that includes public consultation and ultimately approval by the Minister for Planning.
